Medical Cannabis Program – and Conditions

1. Acceptance of Terms
By accessing or using https://medical.cannara.ca ( (the "Site") or registering as a patient with Cannara Biotech (Quebec) Inc. ("Cannara"), a holder of a licence for sale for medical purposes under the Cannabis Act and Cannabis Regulations, you agree to be bound by these Terms and Conditions, our Privacy Policy, our Shipping Policy, and our Refund and Return Policy. If you do not agree, you must not use the Site or register as a patient.

2. Eligibility and Patient Registration
  • Residence and Eligibility: You must ordinarily reside in Canada to register as a patient. If you are under the age of majority in your province or territory of residence, or are otherwise unable to complete the registration process yourself, your application may be completed or signed by a parent, legal guardian or other responsible adult, as permitted by applicable law and the federal Cannabis Regulations.
  • Responsible Adults: Where an adult who is responsible for a patient completes or signs a registration application, accesses the patient’s account or places an order on the patient’s behalf, that adult represents that they are entitled to act for the patient and to complete the applicable activity in accordance with the Cannabis Regulations and other applicable law and agrees to comply with these Terms in connection with the patient’s registration and account. Cannara may require information or documentation reasonably necessary to verify the adult’s identity, authority and responsibility for the patient.
  • Medical Document Requirement: Registration as a Cannara patient requires:
    • A valid medical document from a Canadian healthcare practitioner authorized under applicable law to authorize the use of cannabis for medical purposes.
    • Proof of identity and age (government-issued photo ID)
    • A Canadian shipping address permitted under the Cannabis Regulations and accepted as part of the patient’s registration
Cannara may refuse a registration application where permitted by the Cannabis Regulations, including where the application or supporting information is incomplete, inaccurate, invalid or does not satisfy the applicable requirements. Cannara may suspend access to an account where reasonably necessary to investigate unauthorized activity, protect the account or comply with applicable law. Cannara may revoke a patient registration only in accordance with the grounds, notice requirements and procedures prescribed by the Cannabis Regulations.
  • Account Responsibility: The registered patient and, where applicable, any adult responsible for the patient are responsible for all activity conducted through the account. Account credentials must not be shared with any other person. Cannara must be notified immediately at medical.support@cannara.ca if unauthorized access or use is suspected.
 
3. Ordering and Purchasing Limits
  • Daily Quantity Limits: Federal Cannabis Regulations restrict the daily authorized quantity per patient as specified in your medical document. The quantity of cannabis that Cannara may sell or ship to you is limited by your authorized daily quantity and the limits prescribed by the Cannabis Regulations. Cannara may reduce, delay or refuse an order where fulfilling it would exceed an applicable regulatory or registration limit.
  • Shipping: Orders are shipped in accordance with Cannara’s Shipping Policy, available at Cannara’s Shipping Policy, using Purolator or another carrier selected by Cannara. Available shipping services, delivery requirements and location restrictions may vary.
  • Order Acceptance: All orders are subject to Cannara's acceptance. We may refuse or cancel an order at any time prior to shipment for reasons including but not limited to: stock unavailability, suspected misuse, regulatory concern, or failure to verify patient registration.
 
4. Pricing, Payment and Taxes
  • Pricing: Prices are listed in Canadian dollars (CAD) and are exclusive of applicable federal, provincial and territorial sales taxes unless otherwise indicated. You are responsible for paying all GST, HST, QST, provincial sales taxes and other taxes applicable to your purchase, which will be calculated and charged based on the delivery destination and applicable law. Cannabis excise duties, where applicable, may be included in the displayed product price.
  • Payment Methods: Payment is processed at checkout via Authorize.Net or another payment processor to be chosen at Cannara’s sole discretion. By submitting payment information, you authorize the charge to your payment method.
  • Compounded Fees: Where shipping, handling, or other fees apply, these are disclosed at checkout before order confirmation.

5. Returns and Refunds 
Returns and refunds are governed by the Cannara Refund and Return Policy, available at Cannara’s Refund and Return Policy as well as applicable law. In summary: because cannabis is a regulated product, products generally may not be returned except where Cannara authorizes or requires the return, including in connection with an incorrect shipment, damaged or defective product, product complaint, investigation or recall.

6. Acceptable Use of the Site
You agree not to:
  • Use the Site for any unlawful purpose
  • Attempt to access accounts other than your own
  • Reverse-engineer, scrape, or systematically extract content from the Site
  • Resell, sell, redistribute, divert or provide a cannabis product to any person other than the registered patient for whose medical purposes it was purchased, except as expressly permitted by applicable law
  • Misrepresent your identity, age, or medical authorization
 
7. Intellectual Property
All content on the Site, including text, graphics, logos, product photographs, and software, is the property of Cannara Biotech (Quebec) Inc. or its licensors and is protected by Canadian and international intellectual property law. You may not reproduce, distribute, or create derivative works without prior written consent.

8. Disclaimers
  • Medical Information is not Medical Advice: Information made available through the Site, including information concerning cannabis products, cannabinoid content, dosing, methods of consumption, potential effects or therapeutic uses, is provided for general informational and educational purposes only. It is not intended to constitute medical advice, diagnosis or treatment and is not a substitute for advice from a qualified healthcare practitioner. You should consult your healthcare practitioner regarding whether cannabis is appropriate for you, the products and quantities you should use, and any potential interactions with medications, health conditions or other substances.
  • Use by Registered Patient: Cannabis products purchased through the medical program are intended solely for use by the registered patient for whose medical purposes they were purchased. Products must not be sold, redistributed, diverted or provided to another person, except as expressly permitted by applicable law.
  • Directions and Warnings: You must use and store all products in accordance with the product label, packaging, instructions provided by Cannara, the advice of your healthcare practitioner and applicable law. You should not exceed the quantity authorized by your healthcare practitioner or use a product in a manner inconsistent with its labelling or intended use.
  • Individual Effects: The effects of cannabis may vary from person to person and may be influenced by factors including the product used, cannabinoid concentration, method of consumption, dosage, individual tolerance, medical condition, medications and the use of alcohol or other substances. Cannara does not guarantee that any product will produce a particular therapeutic effect or result.
  • Impairment: Cannabis may cause impairment, drowsiness, dizziness or reduced concentration and coordination. Do not drive, operate machinery or engage in any activity requiring alertness while impaired by cannabis. You are responsible for complying with all applicable laws concerning impaired driving and the use of cannabis.
  • Storage and Security: Cannabis products must be stored securely, in their original packaging where practicable, and out of the reach of children, young persons, pets and any person for whom the product was not intended. You are responsible for the safe storage, handling and disposal of products delivered to you.
  • Adverse Reactions and Emergencies: Stop using a product and seek appropriate medical assistance if you experience a serious or unexpected adverse reaction. In a medical emergency, contact emergency services immediately. You should also report suspected adverse reactions or product-quality concerns to Cannara at medical.support@cannara.ca and provide any information reasonably requested for health, safety, regulatory or product-investigation purposes.
  • No Change to Existing Treatment: You should not discontinue, reduce or change any prescribed medication or medical treatment based solely on information available through the Site or without first consulting an appropriate healthcare practitioner.
  • Site Availability: Cannara will take reasonable steps to maintain the Site but does not warrant that access will be continuous, uninterrupted or error-free. Nothing in these Terms excludes or limits any legal warranty, product-safety obligation, duty to provide adequate warnings or other right or remedy that cannot lawfully be excluded or limited.
 
9. Limitation of Liability
To the maximum extent permitted by applicable law, Cannara will not be liable for any indirect, incidental, special, consequential or punitive damages arising from or relating to your access to or use of the Site, including any loss of data, loss of opportunity or interruption of access to the Site.
To the maximum extent permitted by applicable law, Cannara’s aggregate liability for direct damages arising solely from your access to or use of the Site will not exceed the total amount paid by you to Cannara during the twelve (12) months preceding the event giving rise to the claim.
 
Nothing in these Terms excludes or limits Cannara’s liability:
  • for bodily or moral injury; 
  • for material injury resulting from Cannara’s intentional or gross fault; 
  • for fraud or wilful misconduct; 
  • arising from a legal warranty, latent defect, inadequate warning or instruction, or product-liability obligation; 
  • where doing so would relieve Cannara from the consequences of its own act contrary to applicable consumer-protection law; or 
  • where liability cannot otherwise lawfully be excluded or limited. 
Nothing in these Terms limits any mandatory right or remedy available under the Consumer Protection Act (Québec), the Civil Code of Québec or other applicable law.

10. Suspension, Account Closure and Registration Revocation
Cannara may suspend or terminate access to the Site or a patient account where the user breaches these Terms, Cannara reasonably suspects unauthorized or unlawful activity, or suspension or termination is required to protect the account, the Site, Cannara or another person. Cannara may refuse an order or revoke a patient registration only where permitted by applicable law and, in the case of revocation, in accordance with the applicable notice and procedural requirements of the Cannabis Regulations. You may request closure of your online account by contacting medical.support@cannara.ca. Closing an online account does not require Cannara to destroy records that it is required or permitted to retain by law. Cannara’s handling and retention of personal information following account closure is described in the Privacy Policy.

11. Governing Law and Jurisdiction
Subject to any mandatory right of a consumer to bring a proceeding in another competent jurisdiction, these Terms are governed by the laws of Québec and the federal laws of Canada applicable therein. Any proceeding commenced by Cannara against a Québec consumer will be brought before the court having jurisdiction under applicable consumer-protection law.

12. Changes to these Terms
Cannara may amend these Terms from time to time, including provisions relating to patient registration, account administration, ordering procedures, payment methods, delivery, returns and refunds, acceptable use of the Site, product-use and safety requirements, and the operation or functionality of the Site. Cannara may also amend these Terms where reasonably necessary to comply with applicable law, regulatory requirements or changes to Cannara’s medical cannabis program. Where required by applicable law, Cannara will provide you with written notice of an amendment at least thirty (30) days before it takes effect. The notice will clearly set out the new or amended provision, the provision as it previously read, the effective date of the amendment and any right you may have to refuse the amendment and terminate the agreement and close your account without cost or penalty. Any resulting revocation or transfer of a patient registration will be handled in accordance with the Cannabis Regulations. Cannara will not unilaterally amend any element that may not lawfully be amended under applicable consumer-protection legislation. Where an amendment increases your obligations or reduces Cannara’s obligations, you may, where required by applicable law, refuse the amendment and terminate your registration or account without cost or penalty by notifying Cannara no later than thirty (30) days after the amendment takes effect. Amendments required immediately by law, a regulatory authority or an urgent health, safety or security concern may take effect on shorter notice where permitted by applicable law. The version of these Terms in effect when an order is accepted will continue to apply to that order. Your continued use of the Site or your account after an amendment takes effect constitutes acceptance of the amended Terms, except where you have exercised a right to refuse the amendment under applicable law.
Nothing in this Section limits any right available to you under applicable consumer-protection legislation.
